What you will learn

  • This module discusses the contract documents, programmes, planning, project records and notices and focuses on how good contract administration systems and procedures will help matters relating to claims.
  • The assignments require you to discuss contract administration systems on projects on which you have worked and suggest ways that you may have helped or hindered claims.
  • Assignments also cover procedures for managing claims and the writing of contractual notices in the correct form.

  • The ability to identify events that may give rise to claims is essential and this module discusses the various types of claim that are common within the industry.
  • The module asks you to examine four case studies and identify circumstances that may lead to claims.
  • You are also required to identify entitlement for the claim issues under the contract, discuss any legal principles that may be relied on and describe how the claim should be evaluated.

  • A claim strategy will dictate how claims are to be presented and how the respondent will deal with them. This module guides you into deciding suitable strategies from both the claimant’s and the respondent’s points of view.
  • The first sections of a claim or response document should provide background information on the project, details of the contract and set the scene for the claim so that the reviewer may properly understand the issues in question. You are required to study these principles and produce an example of the preliminary sections of a claim document.

  • The analysis of cause and effect is one of the most important parts of a claim or response and if not dealt with correctly the claim may fail.
  • In this module you are guided through the linkage of cause and effect and are required to produce cause and effect narratives, in the format that they could be included in a claim, for events detailed in a case study.

  • This module firstly builds on the subject from Module 4 and discusses how a delay analysis should be used to demonstrate the effect of a delay on the time for completion.
  • You are required to perform and produce claim narratives, based upon simple examples and using two common delay analysis techniques: time impact and impacted as planned delay analysis.
  • The second part of the module deals with the claimant’s entitlement. You are required to examine two case studies and produce narratives that could be included in a claim to properly demonstrate the claimant’s entitlement.

  • Every claim requires a response and a response document should deal with the matter in a way that persuades both the claimant and the project owner that the response or determination of the claim is correct.
  • This module asks you to produce response documents for three claims that are presented with varying degrees of detail and also to respond to them from both an equitable standpoint and a defensive point of view.

  • The final module builds upon all the lessons learned in the previous modules and you are required to produce an extension of time claim for one of the case studies.

Assignments - Modules 1-7

You will be asked to complete 3-5 assignments for each module, except for modules 4 and 7 where there is just one assignment. You will be asked to submit your assignments to your personal tutor for grading. Your tutor will provide feedback and advice where necessary and each assignment grade counts towards your overall course grade. You must achieve the minimum 55% pass grade for each module to continue onto the next one. If you do not achieve this, your tutor may ask you to resubmit part or all of the assignment to ensure that you fully understand the module content and to help you achieve a good overall course grade.

There are no minimum qualifications, but you will need to understand the construction process and have a basic knowledge of construction contracts. The course is suitable for many disciplines, but particularly, quantity surveyors, contract administrators, engineers and those who deal with contractual and commercial matters. Those whose job it is to manage claims will also gain knowledge of the process and those who wish to gain the necessary skills and knowledge to progress up the career ladder will be able to do so with confidence.

The registration process is simply. Simply go to the course registration page and sign up online. You’ll be asked to complete a basic registration form and make payment (taken via all major credit cards). You’ll then receive an order confirmation and a welcome email with all the details you need to get started will follow shortly afterwards.

We understand that you are likely to be balancing a busy work life with family commitments and everything else in between. We therefore provide flexible study times and allow up to 60-days to complete a module. If you submit a module after this 60-day time frame though, you will incur a 15% deduction on your grade for that module.

You may defer the issue of each module for as long as you wish. Once the module is issued, however, you must complete it within the 60-day time frame in order to avoid the 15% deduction from your assessment mark for that module.

When your tutor has assessed the module, you will be sent the marking sheet, which will contain your tutor’s comments. This will highlight areas that need to be re-studied and provide you with objectives for improvement. We also recommend that you contact your tutor at this stage to discuss your work in more detail. You may then re-submit the assignment or, if your tutor agrees, the individual sections of the assignment that need to be improved.

One of the books required for the course is Construction Claims & Responses: effective writing and presentation by Andy Hewitt and details of where to purchase this book can be found here on our Publications page. The other book required for the course is the FIDIC Conditions of Contract for Construction: For Building and Engineering Works Designed by the Employer (1st Ed. 1999). This book can be purchased directly from the FIDIC Bookshop.

You will receive a certificate to confirm that you have successfully graduated. Your certificate will denote the date of graduation, your pass grade (pass, merit or distinction), the modules studied, the CPD hours gained and logos of the accrediting bodies.

There is no set time-frame for the duration of the course as it is dependent on how much time you can devote to studying. To help keep you on track, we apply a 60 day time-frame for you to complete each module but if you finish a module in 10 days, for example, you are free to submit it to your tutor early. We ask that you allow your tutor up to 7 days to return your assessment grade. So, if you took the maximum 60 day time frame to complete each module and your tutor took the maximum 7 day time frame to assess your assignments, the course could take you up to 1 year and 4 months to complete. We have had students who have completed the course in as little as 4 months though. As we said earlier, it really depends on how much time you can devote to studying.

Whilst the topic is the same, the Construction Claims Distance Learning Course deals with construction claims in much more depth than the basic and intermediate versions. Students are guided through 7 modules and are assessed based on assignments associated with each module. Module 7 brings all of the course concepts together and requires the student to prepare a full extension of time claim.

On completion of the course, students will be more than well equipped to deal with claims in a professional and proper manner.

Our students come from many different countries and are used to working with both international and domestic forms of contract. We use the FIDIC Red Book (1st Ed. 1999) to illustrate the course firstly, because it is written by engineers for engineers in a straight-forward and easily understood manner, secondly because it contains conditions that are typical of any construction contract and lastly, because it is widely used internationally.

After a little familiarisation, students who are familiar with other types of construction contract (JCT, NEC, bespoke forms, etc.) will have no difficulty in understanding the Red Book, or applying it to the case studies and examples used on the course.

Assignments - Modules 1-6

At the end of each module, there is an assignment which will require you to answer questions or complete exercises related to that topic. You will be asked to submit your assignments to your personal tutor for grading. Your tutor will provide feedback and advice where necessary and each assignment grade counts towards your overall course grade.

If you’re someone who struggles with claim writing, perhaps it’s new to you, your claims keep getting rejected or perhaps you just want a refresher, then this course is for you. We will teach you how to set up contract administration systems to efficiently manage claims, how to to identify claims, how to calculate extensions of time by way of delay analyses and how to write and put claim narratives together in a clear and professional way. To ensure we provide a fully rounded learning experience, we will also teach you to to write a claim response, how to make a determination and finally, what to do when the parties can’t agree. You will graduate this course with a solid understanding of claims and will be immediately able to apply what you have learnt to the next claim you work on with confidence and clarity.

Each module contains various assignments which you will undertake after you have watched all the video tutorials for that module. Once you have completed your assignments, you will upload them to your tutor via the student website. Your tutor will comment on and grade your work and issue your module grade to you via email. At the end of the course, you should have achieved an average grade of 55% to pass.

Whilst the course is intended to be flexible to accommodate time constrained professionals, our research during the trial phase told us that students would prefer a deadline otherwise, if they know the course is always there, they do not actually tend to complete it.

We believe that you have a reason and motivation to sign up to a course and we want to make sure that you complete it so, from the date of enrollment, you have 6-months to complete the course. After 6-months, your access to the Student Website will expire and you will no longer have access to the course content. 6-months will give you plenty of time to get through the content and make sure that you achieve what you set out to do, win win!

The Construction Claims Intermediate E-Course is effectively our 2-day Construction Claims Workshop (that we hold face-to-face) in an online, e-course, format. The 6 modules are delivered via video tutorials and the assignments are designed to get you thinking about each module and embed your learning. This course is best for you if you would like an introduction to claims, a refresher course, or don’t have the time for a lengthier learning process. As a graduate, you will have a solid understanding of claims.

In comparison, the Construction Claims Distance Learning Course is a much more in-depth course. The 7 modules are delivered via email and each module involves reading, of the module itself and of the core text, and assignments. There are between 2 and 5 assignments for each module and the final module asks you to write a full claim document, based on a given case study. This course is best for you if you are striving to be a good claims practitioner and want to specialise in this area. As a graduate, you will have a deep understanding of claims and be able to practically apply what you have learnt to your job.
