Why is it important to understand your contract (from a claims perspective)?

Did you know that there are 11 clauses in the FIDIC Red Book form of contract that allow the Employer to claim money from the Contractor and 16 clauses that allow the Contractor to claim either time, money or both from the Employer?

No? Well, to be honest, neither did I until I sat down and counted them when writing a book on the subject…and I have been dealing with the FIDIC contracts in detail and extensively for around 15 years!

This just goes to show that if an ‘expert’ such as myself is sometimes surprised by things, then less familiar users will almost definitely fail to appreciate all the nuances of what are very complicated contracts.

Firstly, we would like to wish all our blog readers a happy, healthy and prosperous New Year. We realise this is more than a little delayed (we can’t believe it’s March already!) but that’s because we have been busy behind the scenes working on a new and improved version of Claims Class AND we’re excited to now be able to share some details of our plans with you!

In 2017, Claims Class will be venturing into the world of e-courses!

Why? Well…

Claims Class is a small and friendly training and education provider and over the past 5 years we have grown the Claims Class brand and delivered courses across the Middle East, South- Asia, the UK, South Africa and Ireland.

During this time, we have built a good reputation for our training and we now receive enquiries from people all over the world asking if we plan to present our training courses in their countries.

Whilst we would love to deliver our courses in more regions, costs and logistics mean that we need large numbers of attendees for the courses to be economically viable and, without good connections for marketing, this becomes a challenge.

Times have also changed. Whilst there is still great benefit in attending face-to-face training courses (and don’t’ worry, we’ll continue to run those), we realise that busy, time-constrained professionals want access to quality training at times and from locations that are convenient to them. We wanted to meet that need.

So, what can you expect from our e-courses?

Construction Claims Distance Learning Course | A Graduate’s Perspective

When I enrolled on the Claims Class Distance Learning Course, I was approaching 10 years of experience. During that time I had dealt with claims on both sides of the fence, with a reasonable degree of success, so I was by no means a novice.

So why did I enrol on the Distance Learning Course? I have seen claims presented in all shapes and sizes, good and bad.  I too have been guilty of structuring claims or responses in different ways, simply because I was unaware of a tried and tested method.  Knowing that this was something that I could improve on, I went in search of the answer and stumbled across the core text for the course: Construction Claims & Responses – effective writing & presentation, which goes through the preparation of a claim from A to Z in minute detail. Registering for a training course may seem like a relatively easy decision. You receive information about a course, it peaks your interest and you do a bit of digging…

You’ll check the dates and times to make sure you’re available, you’ll check the price and make sure that it’s within your budget, you’ll look at the course content and make sure it’s aligned with what you’re looking for and you’ll probably check out the presenter profiles.

If everything looks good, you sign up.
